Terms and Conditions Toptalent Dressage:

 

Our general terms and conditions are in accordance with the provisions of the Consumer Authority. Your rights as a consumer are therefore well safeguarded.

 

Article 1. Definitions and applicability:

 

1.1 These general terms and conditions (hereinafter referred to as: Terms and Conditions) apply to all offers, orders and agreements of Toptalent Dressage. The general terms and conditions can only be deviated from after written agreement with Toptalent Dressage. Both Toptalent Dressage and the customer recognize the legal validity of electronic communication, as also stipulated in European regulations. The customer cannot derive any rights for future transactions from any agreed deviations.

 

1.2 Accepting an offer or placing an order means that you accept the applicability of these terms and conditions.

 

1.3 It is only possible to deviate from the provisions of these terms and conditions in writing, in which case the other provisions remain in full force.

 

 

 

Article 2. Offers / agreements / dissolve:

 

2.1 All offers from Toptalent Dressage are without obligation and Toptalent Dressage expressly reserves it

 

right to change prices, in particular when this is necessary on the basis of (legal) regulations.

 

2.2 An agreement is only concluded after acceptance of your order by Toptalent Dressage. Top Talent Dressage reserves the right to refuse orders. You will be informed of such a refusal within 3 working days, with or without reasons. In that case, any payment already made will of course be immediately refunded to the bank account from which this payment originates.

 

2.3 By ordering from us - via the website or by e-mail - a legally valid purchase agreement is created on which payment must follow. This agreement can only be dissolved if you, as a customer, notify us within 14 days of entering into this agreement that you wish to dissolve the purchase agreement. The agreement is not dissolved until you have received a confirmation from us by e-mail, the order is then canceled.

Article 3. Prices / shipping costs / payment / non-payment: 3.1 The stated prices for the products and services offered are in euros including VAT. 3.2 We charge € 6.95 for transport within the Netherlands. For customers from countries other than the Netherlands, the contribution to the shipping costs depends on the country and the amount of the order. The seller reserves the right to conform this amount to the most current rates for these services by PostNL. 3.3 We work by means of prepayment (online or in advance by bank transfer). After an order you will immediately receive a confirmation by e-mail with the total costs, including shipping costs. No additional costs are charged for online payments (iDeal / PayPal). After receipt of your entire payment, we will ship your order immediately. All articles remain the property of TopTalent Dressage until full payment has been received. 3.4 There is non-payment if 21 days after the conclusion of the agreement the invoice amount has not or not yet been paid in full. The buyer will then be reminded in writing to pay the entire or the remaining amount plus € 10.00 administration costs immediately. If the amount is not paid within 7 days, the seller is entitled to collect the amount to be claimed plus the said administration costs through legal channels. 3.5 Payment with bank account outside the Netherlands: in this case it is required that you state the BIC and IBAN code associated with our account number 0006 4698 90. By specifying these codes, the bank transaction is free for both parties and no bank costs are charged. The codes are as follows: BIC: INGBNL2A IBAN: NL30INGB0007870351. If it is omitted to state these codes and as a result bank costs are charged to TopTalent Dressage, the latter reserves the right to deliver the order only after full compensation of these costs.

Article 4. Delivery: 4.1 In principle, we ship all orders within 3 working days, after receipt of the full payment, via PostNL to the delivery address specified in the order. If we deviate from this for certain reasons, you will be notified by e-mail. We ship the order via the secure registered mail delivery of PostNL, which means that you must sign for receipt. If you are not at home at the time of delivery, you can pick up the package at the postal agency in your area. If the package is not picked up within 3 weeks, the package will be returned by us. We will refund the purchase amount minus the shipping costs. 4.2 Exceeding the agreed delivery times does not entitle the customer to compensation, dissolution of the agreement or non-fulfillment of any obligation that may arise for him / her from this or any other related agreement. 4.3 The product must be delivered to the customer no later than 30 days after ordering. If this does not happen, the customer can immediately cancel the purchase. This does not apply if the parties have agreed on a different delivery period. 4.4 Delivery in parts is permitted. 4.5 We do our best to keep the website as up to date as possible. However, it may happen that an item is no longer available. In that case we will contact you as soon as possible.

Article 5. Right of withdrawal / return: 5.1 After receipt of the ordered item (s) you have a reflection period of 14 days. Within this withdrawal period you have the option to inform TopTalent Dressage by e-mail or in writing that you wish to return the order or part of it. Returns are only possible after you have received an agreement from TopTalent Dressage by e-mail. You may select a replacement item or receive a refund if you wish. If a return is approved, you will receive a confirmation with the return number. The item to be returned must be returned to us within 5 working days after approval by Toptalent Dressage, with the required return number and received by us. 5.2 The article must be checked upon receipt for any errors, imperfections or damage. These must be reported to us by e-mail within 2 days. Items with an error, imperfection or damage that are returned without notification of an error, imperfection or damage within 2 days of receipt cannot be accepted. 5.3 We will resolve any problem as soon as possible. If the solution does not meet your expectations, you can cancel the order without additional costs. This warranty expires when: a. The article has been worn and / or washed; b. The article is damaged and / or you have tried to repair the damage or defect to recover; c. You have not followed the instructions for use and / or instructions for use. 5.4 The return shipment will be confirmed by e-mail after correct receipt. Also will the refund will also be confirmed by email. We will instruct the bank and / or credit card company to return the amount to you. The amount already paid will be refunded to you within 7 working days after the order has been returned (via credit card company or directly). Do take into account the processing time of the bank and / or credit card company. The entire procedure can take approximately 2 weeks.5.5 The costs for return shipment are for your own account, Toptalent Dressage will not refund this, unless otherwise agreed. Returns must always be sufficiently stamped, otherwise they will not be received. 5.6 You are responsible for the returned items. A condition for actually using your right of withdrawal is that the relevant items are properly packaged, complete, undamaged, unused and returned in the undamaged and original packaging together with a copy of the invoice. If damage has occurred as a result of inadequate shipping packaging or if the mail item is insufficiently stamped, Toptalent Dressage reserves the right to refuse a return shipment. We therefore advise you to send returns as a Secure package via PostNL. More info, see: PostNL. 5.7 The right of withdrawal does not apply to: - Promotional items, discounted items, accessories, appliqués, buttons, zippers, jewelery and hygiene sensitive items.- Products that are made "in accordance with the consumer's specifications", such as a tailored suit- Products that are clearly personal in nature.- Products that are not suitable to be returned for hygienic or health reasons and are therefore sealed. Examples include swimwear and underwear. 5.8 The right of withdrawal lapses if the buyer has not complied with the payment term of 21 days, as referred to in article 3.4.

Article 6. Liability: 6.1 Any liability of TopTalent Dressage and of the personnel and products of TopTalent Dressage for all damage, of whatever nature, direct or indirect, including trading loss, consequential damage, damage to movable or immovable property or to persons, is expressly excluded. Dressage is also not liable for damage caused by third parties during the execution of the agreement. 6.2 TopTalent Dressage accepts no liability for any damage resulting from the use of the TopTalent Dressage articles. 6.3 Any liability of TopTalent Dressage towards the buyer is in any case limited to ten the highest the invoice amount that the buyer owes to TopTalent Dressage under the relevant agreement. 6.4 For misunderstandings, mutilations, delays or inadequately presented orders and communications as a result of the use of the internet or any other means of communication in the traffic between the customer and TopTalent Dressage, or between TopTalent Dressage and third parties, insofar as they relate to the relationship between the customer and TopTalent Dressage, TopTalent Dressage is not liable, unless and insofar as there is intent or gross negligence on the part of TopTalent Dressage.

Article 7. Force majeure: 7.1 In case of force majeure, TopTalent Dressage has the right, at its own discretion, to suspend the execution of your order, or to dissolve the agreement without judicial intervention, by notifying this in writing and without TopTalent Dressage being obliged to do so. to any compensation, unless this would be unacceptable in the given circumstances by standards of reasonableness and fairness. 7.2 Force majeure is understood to mean any shortcoming that cannot be attributed to TopTalent Dressage, because it is not attributable to its fault and is not accountable for by law, legal act or generally accepted views.   

Article 8. Miscellaneous: 8.1 If you state an address in writing to TopTalent Dressage, TopTalent Dressage is entitled to send all orders to that address, unless you notify TopTalent Dressage in writing of another address to which your orders should be sent. 8.2 When TopTalent Dressage permits deviations from these Conditions, whether or not tacitly, for a short or longer period of time, this does not affect its right to demand immediate and strict compliance with these Conditions. You can never assert any right on the basis of the fact that TopTalent Dressage applies these Terms and Conditions flexibly. 8.3 If one or more of the provisions of these terms and conditions or any other agreement with TopTalent Dressage are in conflict with any applicable legal provision, the relevant provision will lapse and will be replaced by a new legally permissible comparable provision to be determined by TopTalent Dressage. 8.4 Toptalent Dressage is authorized to make use of third parties in the execution of your order (s).

Article 9 Applicable law / disputes: 9.1 All rights, obligations, offers, orders and agreements to which these terms and conditions apply are exclusively governed by Dutch law. 9.2 Any disputes that cannot be resolved without the intervention of a judge will be submitted to a court to be designated by TopTalent Dressage.
